Abstract

Discusses Davenport v. State, a Texas Court of Criminal Appeal’s case. The Court in Davenport held that, due to the administrative nature of revocation proceedings, a probationer may be subjected to them more than once on the same factual basis, without violating double jeopardy or res judicata. The author believes that this decision opens the door to harassment by prosecutors and advocates for the opposite holding.
