Abstract
Examines the United States Supreme Court’s case Owen v. City of Independence. The Court in Owen held that municipalities do not enjoy qualified immunity from liability for violations of constitutional rights under § 1983. Further, good faith of officers is not a defense to suit. The author comments that the scope of municipal liability must still be addressed and believes these decisions should be based on policy considerations.
