Abstract
Focuses on the need for and development of both workers' compensation and comparative negligence principles, the conflicts created by the interaction of the two principles, and various jurisdictions' approaches to these conflicts. The authors then suggest a proposal that will keep both doctrines intact and resolve conflicts that arise when an employee, employer, and third party are involved in a single products liability cause of action.
