Abstract

A case study on a San Antonio Court of Appeals case, which held that the marital status of the petitioner was an impermissible standard by which to determine the best interests of a child. The article analyzes the “best interest of the child” standard and the single factor limit on the court’s discretion. The author details the current stature of the law after the case and suggests the future implications of the case.
