Abstract
Surveys contemporary environmental law cases decided by the Fifth Circuit. In the majority of instances, the court decided very narrowly and followed established precedent. Notable decisions include that a debtor may not avoid compliance with applicable environmental laws via the automatic stay provisions of the Bankruptcy Code, and that the EPA may not collect noncompliance penalties for the time period between the four months following a state’s submission of a revision to its State Implementation Plan to the date of rejection of that revision.
