Item Banking Law(Texas Tech Law Review, 1992) Hale, H. DeWayne; Barnett, Sheli L.During the survey period, June 1, 1990 through May 31, 1991, the United States Fifth Circuit Court of Appeals handed down a number of banking law decisions. This article will focus upon four areas in which the appellate court ruled: the federal holder in due course doctrine, the assignment of rents clause in a Texas deed of trust, the applicability of D'Oench, Duhme/Section 1823(e) on a homestead claim and the notice required for a proper foreclosure sale of personal property.
