Item Court Cannot Judicially Terminate Testamentary Trust On Grounds That Primary Purposes Have Been Accomplished If Trust Calls for Termination At Stated Event(Texas Tech Law Review, 1978) Alexander, LynnExamines the Texas Supreme Court’s case Frost National Bank of San Antonio v. Newton. In Newton, the Court held that a trust may not be terminated by a judicial determination that its main purpose had been accomplished when the express terms of the trust “provide[d] for its termination upon the happening of specified events.”
